Does Full Spectrum CBD Oil Have THC?

The hemp plant is a variety of cannabis that contains very low concentrations of THC. Legally, industrial hemp should only contain up to 0.3% THC. Full Spectrum CBD may undergo an additional processing step to remove the THC traces and create another type of CBD called Broad-Spectrum CBD or undergo cooling and purification to obtain CBD isolate. 

Broad-spectrum CBD contains all the compounds found in the Full Spectrum extract but contains no THC. CBD isolate contains only one compound, cannabidiol. Isolates are the purest form of CBD, with some products reaching up to 99% purity.

Is THC in Hemp-Derived CBD Oil Illegal?

Hemp plants and hemp products are legal federally in the United States. As we have mentioned before, hemp contains traces of THC, but as long as the levels are below 0.3%, it’s deemed legal under the 2018 Farm Bill.

The 2018 Farm Bill removed hemp from Schedule I controlled substances and made it legal for cultivation and trade. Section 10113 of the 2018 Farm Bill defines hemp as Cannabis Sativa L, all derivatives, cannabinoids, acids, salts of the plant with a delta-9-THC concentration up to 0.3% on a dry weight basis.

The THC quantities are also too minuscule to cause any negative effects. This means using Full Spectrum CBD will not get you high.

However, it’s up to you, the consumer, to ensure the Full Spectrum CBD product you buy is made from industrial hemp and not marijuana. Marijuana is still a schedule I controlled substance federally, which means its extracts are illegal.
